Grech RV'S Warranty

GRECH RV WRITTEN LIMITED WARRANTY

Grech RV is the final stage manufacturer of a previously incomplete vehicle distributed and warranted by Mercedes-Benz USA, LLC. The limited warranty described in this booklet (“Grech RV Limited Warranty”) is provided by Grech Motors, Inc. d/b/a Grech RV located at 6915 Arlington Avenue, Riverside, California 92504. The Grech RV Limited Warranty gives you specific legal rights, and you may also have other rights which vary from State to State.

WARRANTY PERIOD

The Grech RV Limited Warranty begins on the date the Grech RV motorhome is purchased by the first retail customer, leased, or used as a demonstrator. Coverage for adjustments to latches, handles, hinges and drawers and the replacement of light bulbs, fuses, and disposable batteries ends upon the expiration of ninety (90) days. All other coverage ends upon the expiration of thirty-six (36) months or 36,000 miles on the odometer, whichever occurs first.

WHAT IS COVERED

The Grech RV Limited Warranty covers the cost of parts and labor necessary to correct any defect in components added, and workmanship performed, by Grech RV during the final stage manufacturing process. Grech RV will pay to correct any covered defect through adjustment, modification, update, repair or replacement. Replacement parts will be new, used, remanufactured or refurbished parts of like-kind and quality. Coverage is only applicable if you (i) submit a Warranty Service Request (see “How to Obtain Warranty Service”) and (ii) deliver the motorhome to an authorized Grech RV dealership or the Grech RV Service Department within the warranty period. Warranty coverage is subject to all other limitations, terms and conditions provided herein.

WHAT IS NOT COVERED

The Grech RV Limited Warranty applies to defects described in the “What is Covered” section above. Accordingly, without limitation, the following are NOT covered by the Grech RV Limited Warranty:

• Improper use. The Grech RV Limited Warranty does not cover damage or failures caused by abuse, misuse, negligence, improper repairs, improper load weight and distribution, overloading, fire, accident, or failure to use the motorhome in accordance with the instructions in the Owner’s Manual. It also does not cover damage caused by the failure to seek timely repairs or failure to mitigate damage to the motorhome.
• Routine maintenance and preventive maintenance. The Grech RV Limited Warranty does not cover the cost of normal and reasonable motorhome maintenance such as seal replacement, caulking, window sealing, HVAC seals and caulking, joint lubrication, latch adjustments, light bulb replacement, fuse replacements, winterization, fire detection battery replacement, oil changes, and filter replacements. Nor does it cover damage caused by the failure to perform routine maintenance including, but not limited to, a failure to perform proper winterization.
• Modifications and after-market components. For example, the Grech RV Limited Warranty does not cover damage or failures caused by modifications you make to the motorhome, or the installation of after-market components or parts installed by anyone other than Grech RV. By way of example and not limitation, the Grech RV Limited Warranty does not cover damage caused by the installation or use of roof racks, ladders, solar panels, antennas, satellites, third-party HVAC systems, wheels, tires and suspension modification, auxiliary fuel tanks and alternators.
• Characteristics and normal variations. Conditions that exist due to the design of your motorhome and those associated with motorhome use such as slight noise, vibration, wind noise, and other normal characteristics of recreational vehicles are not defects and are therefore not covered under the Grech RV Limited Warranty. Likewise, your Grech RV Limited Warranty does not cover minor variations in color, paint, trim, finishing, cabinetry, grain, and door alignment.
• Normal wear and tear. The Grech RV Limited Warranty does not cover deterioration or damage resulting from normal wear and tear, usage, oxidation, seal deterioration, stains, and exposure to elements.
• Environmental factors and road conditions. The Grech RV Limited Warranty does not cover damage caused by freeze, water contamination, mold, humidity, condensation, rain, hail, tornadoes, hurricanes, lightning, floods, tree sap, tar, oils, potholes, debris, rodents, insects, salts, and other external conditions. Nor does the Grech RV Limited Warranty cover damage due to road hazards, road conditions, collisions, or vehicular traffic.
• Recreational vehicle connections and facilities. The Grech RV Limited Warranty does not cover damage caused by improperly calibrated connections, improper water supply, shore power defects, dirty or inconsistent power, reverse polarity, or waste disposal facilities.

The following are expressly excluded from coverage under the Grech RV Limited Warranty:

• Components and functions covered by other warranties. For example, the Grech RV Limited Warranty does not provide coverage for defects, conditions, or components covered by Mercedes-Benz USA, LLC written limited warranties. Grech RV recommends that you review the warranty coverage provided by Mercedes-Benz USA, LLC. Likewise, it does not cover components that are covered by their own manufacturer’s warranty such as lithium batteries, refrigerator, stove, water heater, furnace, HVAC, and other electronic devices.
• Software bugs and wireless connections. The Grech RV Limited Warranty does not provide coverage for bugs, design issues, and functionality and design of software and firmware. Nor does it provide coverage for wireless connectivity failures between your Grech RV and wireless devices, smartphones, and other computer electronics not provided by Grech RV upon delivery.

HOW TO OBTAIN WARRANTY SERVICE

To obtain warranty service pursuant to the Grech RV Limited Warranty, you must first contact Grech RV and make a Warranty Service Request (“WSR”). You may submit a WSR by contacting Grech RV (i) through the “Contact Us” link located at www.grechrv.com, (ii) at (855) 994-7324, or (iii) by certified mail addressed to Grech RV Service Department, 6915 Arlington Avenue, Riverside, California 92504. Grech RV will contact you to discuss your WSR and seek the most expeditious resolution. If your WSR cannot be resolved by communication directly with Grech RV, covered repairs must be performed at an authorized Grech RV dealership or by Grech RV at the Grech RV Service Department in Riverside, California.

You are responsible for transporting your motorhome to an authorized location when seeking repairs under the Grech RV Limited Warranty. In the event your Grech RV motorhome is disabled and must be towed to an authorized location due to the failure of a component covered by the Grech RV Limited Warranty, Grech RV may reimburse you for reasonable costs of towing actually incurred with proper documentation of such costs.

You are required to contact Grech RV and make a WSR even if you have presented your motorhome to an authorized Grech RV dealership. Authorized dealerships and their employees are not Grech RV’s agent for the purpose of administering the Grech RV Limited Warranty. They cannot amend, modify, or enlarge the obligations under the Grech RV Limited Warranty. Grech RV is not responsible for any undertaking, representation, promise or warranty made by any dealership.

EXCLUSIVE REMEDY & WARRANTY; DISCLAIMERS

The payment for repairs provided herein is the sole and exclusive remedy under the Grech RV Limited Warranty and any other warranty provided by Grech RV. Grech RV makes no other express warranty beyond that contained in this writing.

In no event shall Grech RV be responsible or liable for any INCIDENTAL OR CONSEQUENTIAL DAMAGES either occurring within any applicable warranty period or afterward. All such damages are hereby excluded and disclaimed including, but not limited to, damages for loss of use, living expense, inconvenience, loss of commercial business opportunities, lost profits, lost wages, travel expenses, transportation costs, and expense necessary to deliver the motorhome for coverage under the Grech RV Limited Warranty or any other warranty provided by Grech RV, express or implied. This disclaimer of incidental and consequential damages applies notwithstanding any failure of the essential purpose of the Grech RV Limited Warranty. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.

Any implied warranty of merchantability or fitness for a particular purpose that arises under state law is (i) limited to the duration of the Grech RV Limited Warranty, and (ii) disclaimed with respect to those components not covered under the terms of the Grech RV Limited Warranty (e.g. components covered under the Mercedes-Benz USA, LLC written limited warranties). Some states do not allow limitations on how long an implied warranty lasts, so that limitation may not apply to you.

EVENTS THAT WILL VOID YOUR WARRANTY

Grech RV shall have no liability under this Grech RV Limited Warranty for any motorhome that has ever been declared a “total loss” or “salvage” or the equivalent of those terms by any financial institution, insurer or governmental agency. Nor shall Grech RV have any obligation hereunder in the event the odometer on the chassis has been altered or tampered with.

WARRANTY AND OWNERSHIP REGISTRATION

The Grech RV Limited Warranty provides coverage for any owner of the Grech RV motorhome during the warranty period. Although registration is not a condition of warranty coverage under the Grech RV Limited Warranty, the initial retail purchaser should verify that the authorized selling dealership notified Grech RV of the sale and submitted the New RV Warranty Registration Form. Any owner can register by completing the online registration form found at https://rv.grechrv.com/warranty-registration-lp. By registering as an owner, even after the expiration of the warranty period, you may help Grech RV provide you with important information regarding your Grech RV motorhome. Such information could include notices required by the National Highway Transportation and Safety Administration.

OTHER TERMS

Laws in many states permit owners of motor vehicles to obtain a replacement vehicle or a refund of the purchase price under certain circumstances. Laws in this regard vary from state to state. To the extent permitted by state law, Grech RV requires that you first provide written notice of your intent to seek remedies under such laws so that Grech RV has a final opportunity to make any needed repairs. Notice Regarding California Lemon Law. Grech RV has opted-in to the process and procedures established by Assembly Bill 1755 and Senate Bill 26. For consumers seeking relief under the California Song-Beverly Consumer Warranty Act, notices containing the owner’s name, the motorhome’s Vehicle Identification Number, and a brief summary of the repair history and problems with the motorhome shall be emailed to warrantynotice@grechrv.com or sent by certified or registered mail, return receipt requested as follows:
